Dear Homeowner,

You may have noticed that some homeowner’s mailboxes are looking a little tired and in need of some maintenance and repair.  We would like everyone to inspect their mailbox and make repairs, paint or replace their mailbox and post, as needed, this summer.  All mailboxes should be green with a white post and greenhouse numbers on the FRONT SIDE ONLY of the post.  Posts should not be leaning or have rotted wood.

The following is a checklist to guide you through your own inspection:

2 Damaged mailbox Replace the mailbox with a new one.  You may purchase a new mailbox on-line from Home Depot.  The mailbox you should purchase is:

Elite Medium Size Galvanized Steel Post-mount in Green.

All homeowners are receiving this letter and in some cases no repair is necessary.  Please take appropriate action if your mailbox needs attention.  According to the Heritage Lakes Declaration of Covenants section 7.11 SIDEWALKS; MAILBOX, it’s the homeowner’s responsibility to maintain their mailbox.   

An inspection will be made in September to identify homeowners who have not made the necessary repairs to their mailbox.  We are giving homeowners approximately three months to make the necessary repairs.  After this grace period, a $50 per month fine will be assessed on homeowners who do not repair their mailbox during this period.  A monthly fine will be assessed each month until the mailbox is maintained.  

The positive impact is huge when everyone does their small part!

Dear Neighbors:

Happy Summer!  Hopefully everyone is healthy and safe.  Things are starting to return to normal with the announcement that the Hilliard fireworks will be on July 3rd!  It is always an exciting time in the neighborhood with people celebrating with family and friends and our excellent view of the fireworks.

You may have noticed the annual flower planting throughout the neighborhood including the Heritage Lakes entrance, Heritage Lakes median, and Impatience Park.  You may also have noticed that a lot of dead trees were removed from the Heritage Lakes median, Fairway Commons and Impatience Park. Plans for some tree replacements are in the works.   

Flowers were not planted at the entrance to Fairway Commons this year due to the construction of a crosswalk on Alton Darby scheduled this summer.  For more details see the Heritage Lakes website.  

Impatience Park is also getting a face lift with the removal and replacement of dead trees and bushes and the restacking of the stone wall.  Be sure to check it out and also visit the little library while you are there.  This is part of our ongoing effort to keep the neighborhood looking fresh.  

You should be receiving a letter in the mail from our Property Manager soon asking all homeowners to repair or replace their mailbox.  A copy of this letter will also be posted on our website https://heritagelakeshilliard.org/news/.

We want to thank all homeowners who have been doing a great job taking care of their property by cutting their grass regularly, trimming bushes, trees and shrubs, mulching, edging and weeding their lawns.  Although the vast majority of our neighbors are doing their part in keeping the neighborhood beautiful, we continue to have a problem this time of year with some neighbors who do not maintain their lawns to our neighborhood’s standards.  We ask these neighbors to do their part, not only to avoid HOA fines but more importantly to be good neighbors!!

The City of Hilliard contacted the Heritage Lakes HOA regarding improvements to Alton & Darby Creek
Road pedestrian improvement project as it relates to the Fairway Commons. The City of Hilliard
informed us that the planned improvement will fill a gap in the pedestrian facilities on Alton & Darby
Creek Road between Fairway Commons Drive and Lampton Pond Drive with a proposed 5-ft wide
concrete sidewalk.  The project will also provide a pedestrian refuge island with Rectangular Rapid
Flashing Beacon (RRFB) signage to provide safe crossing of Alton & Darby Creek Road for pedestrians
and bicyclists between Muir Parkway and Fairway Commons Drive.
 
Below is the project description that was shared with the HOA:

This improvement will fill a gap in the pedestrian facilities on Alton & Darby Creek Road between
Fairway Commons Drive and Lampton Pond Drive with a proposed 5-ft wide sidewalk.  The project will
also provide a pedestrian refuge island with Rectangular Rapid Flashing Beacon (RRFB) signage to
provide safe crossing of Alton & Darby Creek Road for pedestrians and bicyclists between Muir Parkway
and Fairway Commons Drive.  The sidewalk improvements at the southeast corner of Alton & Darby
Creek Road and Fairway Commons Drive will essentially mirror the improvements on the northeast
corner.  As we discussed this morning, the extension of the sidewalk on the south side of Fairway
Commons Drive will impact the landscaping bed as it encroaches in the right-of-way, but the fence and
signage will remain undisturbed.  I have provided the following attachments as resources to describe the
project to the Board:

1. Alton Darby Creek Rd at Muir Pkwy Plan Sheet – this is a plan sheet from the construction plans
detailing the improvements of the project.  The sidewalk connection is shown on the right side
of the page.

2. ADCR at Fairway Commons Dr – this is an approximate illustration of how the sidewalk will curve
between the existing signage, but will impact plantings within landscape bed.  Note, that all
sidewalk is to be built in existing Right-of-Way.

3. Ped Refuge Island Example – this image shows a similar installation on Scioto Darby Road east of
Veterans Memorial Drive to what will be constructed on Alton & Darby Creek Road.  However,
the pedestrian refuge island on this project will only be made up of brick pavers inside the curbs
and not include trees in the median.

Further discussions with the City of Hilliard provided the following clarifications:

1. Maintenance of Traffic – this element is still in design, but the intent is to limit disruption to
Alton & Darby Creek Road traffic.  Construction is only permitted during non-peak hours (8:00
AM to 4:00 PM) and would be even more limited if construction occurs during the school year. 
A flagger may be used, but the City intends to limit that to only one or two days during non-peak
hours. 

2. Project Schedule – the schedule is unknown currently, but the City’s plan is to bid this project
along with a few other City bike/pedestrian improvements this Spring.  The schedule will be
more clear once a Contractor has been selected and we will require to said Contractor to notify
you prior to work starting in the area.  If you can provide the best way to contact you, we can
include it in the plans.

3. Notification of Property Owners – we will not be issuing formal notices to the residents of
Fairway Commons at Heritage Lakes as this project will have a fairly short duration and have a
minimal impact on traffic.  The Contractor will be required to notify the resident of 3491 Fairway
Commons Dr prior to working along their property as they are directly impacted. 

4. Mulching Beyond Sidewalk – We have included a note in the plans for the Contractor to rake the
existing mulch back into the bed prior to work.  Once the sidewalk has been built and topsoil has
been set in the surrounding disturbed areas, the Contractor will rake the mulch back to the
sidewalk. 

5. General Community Engagement with the City – we appreciate your interest in getting the
community engaged with the City.  We like to hear back from our residents on the City’s
interests and future plans.  As I mentioned last week, the City recently launched a website for

Dear Neighbors:

I hope you all are healthy and safe in these challenging times. We all have a common vision for
our neighborhood. We all want to see the neighborhood, thrive, and continue to be a vibrant
neighborhood. Heritage Lakes has a lot of charm and character that makes it a wonderful place
to live. There are serious obligations and responsibilities the association has and needs to be
commonly understood by all of us. I would like to discuss those issues in this letter. Typically,
we discuss such issues at our annual Board meeting. However, due to the restrictions imposed
on us due to COVID 19, we were not able to have our meeting as previously scheduled. Below
are some points I would like to share with you:

Annual Board Meeting
The Annual HOA meeting for 2020 was scheduled for April 2, 2020. Due to the COVID-19
crisis, the HOA Board chose to postpone the meeting until further notice. The health and
wellbeing of our neighbors supersedes this meeting. We intend to have our meeting as
scheduled in 2021, assuming COVID-19 is no longer a threat.

Major Activities
– This past year the board put out for bid all service contracts to make certain we were
getting our community the best service at the most reasonable prices. Ramirez
Landscaping was selected as the landscape service provider for our community. We
believe they are doing a good job so far.
– Aqua Doc was selected to maintain the Pond. Aqua Doc treats the pond on a regular
basis and maintains the fountain.
– The HOA Board has selected Beacon Property Management as the Property Manager
for our Homeowner’s Association. Onyx Property Management was not meeting the
needs of our neighborhood and they asked for an almost 300% increase in their monthly
fees. We chose to terminate their contract.
– We removed several dead pine trees on Heritage Lakes Drive, Fairway Commons and
Impatience Park. Replacement of some of the removed trees will be completed in the
upcoming planting season.
– Maintenance of the Bridge wall by the pond.
– Maintenance of the lights at the Bridge wall.
– Maintenance of the Heritage Lakes and Fairway Commons signs.

Communication
We encourage our residents to utilize the HOA’s website www.HeritageLakesHilliard.Org. Our
website includes access to HOA’s Controlling Documents, Welcome Package for New
Neighbors, Frequently Asked Questions, Forms for ARC Requests submissions, and an online
form for submitting questions or concerns to the Board. Also, to improve our ability to get the
word out quickly, we continue to ask residents to share their email addresses with us so that we
may have a more complete and updated e-mail roster of all residents. Please feel free to

For New Homeowners
The operation of your homeowners association is governed by a volunteer board of directors.
The three elected Board members are elected on a staggered basis by the community.

Elections are held at the annual homeowners meeting in April. The Board is responsible for
overseeing the daily functions and financial responsibilities of the Association, and for
maintaining members’ compliance with the established rules and guidelines.  ​Please take the
time to read through the Declarations of Covenants, Bylaws and other controlling documents.

also find a Welcome Package and Helpful Information under the New Neighbors tab

for any projects or are interested in serving on the Board.

Architectural Review Committee (ARC)
The Heritage Lakes HOA has an Architectural Review Committee to help maintain the quality of
our neighborhood. Currently, there are five members serving on the Architectural Review
Committee where three of the five members are engineers. Its function is to evaluate the plans
for all exterior landscaping, repairs and remodeling (such as painting, decks, trees and bushes,
replacement roofs, etc.) in order to ensure compliance with all covenants, restrictions and
guidelines. The purpose of this review is to protect our scenic environment and maintain the
value of our homes. Modifications to the exterior of your home and property must be submitted
to the Architectural Review Committee for approval before any work begins. If work is started
without prior approval, the homeowner may be required to alter or remove the changes.
Requests for ARC approval must be submitted to the Architectural Review Committee through
our electronic form on the HOA Website https://heritagelakeshilliard.org/architectural-review-
form/.  The Board asks for your full compliance with the ARC process as it’s necessary to
maintain the beauty and preserve the quality of Heritage Lakes. The time to get this approval is
before changes are started and not after they are finished.

Landscaping
During the past year, we have seen many positive changes around us. We are pleased with the
many accomplishments of the HOA Board since the transition to Ramirez Landscaping.
Common area management and landscaping continue to be our number one priority.  Although
the neighborhood looks good, we still have more room for improvement. In 2021, we will focus
on the following areas:
– Weed control
– Planting of more vibrant flowers
– Adding new trees to replace the removed dead trees.
– Re-stacking some of the landscaping stones

Covenant Adherence
What makes Heritage Lakes such a great community is the fact that our early developers saw
the need to have strong covenants that would uphold both high standards of quality and
appearance consistency. Compliance with the Covenants and Community Restrictions is
mandatory, and it is the responsibility of each homeowner to be familiar and read the rules and
regulations.  At the time of purchase, it’s the responsibility of the homeowner to familiarize and
read the rules.   Non-compliance will result in the receipt of a violation letter, and ultimately, a
fine or lien placed upon your property if the violation is not corrected. You can view or print a

Lawn Care
The neighborhood looks so beautiful when all the lawns are mowed and cared for.
Unfortunately, there were several homeowners who neglected their lawns this past year. We all
want to keep Heritage Lakes a beautiful and premier neighborhood. Also, we all want to keep
the value of homes high and protect our investments. Please take care of your yard by making
sure you keep up with the neighborhood standards. Mowing, weeding, trimming and watering
as needed are expected of all homeowners. Please do your part.

Mail Posts and Mail Boxes
The maintenance of mail boxes and posts is the homeowners’ responsibility. Please make
sure that your mail box and post are painted and that the post is upright and not leaning in any
direction! Should you want to replace your mail box or post, you can find details of the
approved mail box on the HOA website https://heritagelakeshilliard.org/qa/.

Trash Cans
Homeowners are required by the covenant and Arch Guidelines to maintain your trash cans
inside your garage or behind an approved enclosure, away from public view. Leaving trash and
recycle containers at the street or outside the front of our homes after trash day distracts greatly
from the beauty of the community. Your compliance is required and is also highly appreciated.

Speeding
The neighborhood wide speed limit is 25 mph. We ask our neighbors to comply with the speed
limit and make Heritage Lakes a safer neighborhood for children at play, joggers and walkers.
Also, please ask younger drivers in your families to be safer drivers.

Street Parking
Some of the streets in Heritage Lakes are relatively narrow. In particular, the part of Heritage
Lakes Drive with the wide median makes it difficult for wider cars and truck to pass through
when cars are parked on the street. Frequently, drivers cause damage to the median when
passing a parked car. The problem is even greater when larger vehicles such as school buses
and trash trucks try to navigate through this narrow street with parked cars. The same problem
is observed on Fairway Commons roundabouts where cars are parked on the roundabout
restrict the movement of large landscape trucks, delivery truck and other larger vehicles.
Please be a good neighbor and park your car in your driveway. In many cases, when trucks
drive over the median to avoid parked cars, they cause damage to the median or to the sprinkler
system. Repairing the damage costs the HOA money that can otherwise be spent on
improvement projects. We hope that we get everybody’s compliance with this requirement.

Speaking for the Heritage Lakes HOA Board, we look forward to continuing to serve the
community. Our vision for the future of Heritage Lakes is very bright. Please do your part to

Heritage Lakes Homeowners Association

On behalf of the Homeowner’s Association Board, I would like to give you an update on the status of our property management contractor.   As you know, in May 2019, we terminated our contract with Full Circle Property Management (Rickert). We selected Clark Simson and Miller (CSM), a remote property management company to serve the remainder of the 2019 fiscal year.  

The Board continued to search for a local competent property management company to serve as our property manager.  I am happy to inform you that we finalized a contract with Onyx Realty. The transition from CSM to Onyx has already started. We believe Onyx is a good fit for the neighborhood and is ready to serve our community. We hope to use their services for many years to come.   

In the following pages of this mailer, Mr. Douglas Davis, Onyx Realty President, provides you with an introduction letter about the company and their services. A face-to-face introduction of Onyx will take place at our next Board meeting in April 2020. Please feel free to contact me if you have any questions or concerns.
